Terms and Conditions


PhoneTag services are available to you under the following terms and conditions as revised from time to time by PhoneTag. The current version of these terms and conditions will always be posted at www.PhoneTag.com. If you should break the rules provided in this agreement, we may have to suspend or terminate your service.

  • Fees

    • You can always check www.PhoneTag.com for our latest published prices and the prices that will be applied to your Account. When using the PhoneTag service, your voicemails are diverted to your PhoneTag voicemail box. If you choose to dial into your PhoneTag voicemail box, your Network Operator will charge you at your standard rate. Roaming charges may also be applied by your Network Operator in addition, if you should dial in while roaming.
    We suggest you check the costs applied by your network operator for each of the above services. PhoneTag is not responsible for any charges applied by your network operator. We track the number of transcriptions and reserve the right to charge for undelivered SMSs except where the failure to deliver is shown to be our fault. Every SMS consists of 160 characters, as controlled by the GSM Association. Should a message exceed a single SMS in length, we will add additional SMSs, each up to 153 characters.
    PhoneTag reserves the right to limit the use of the service if we find any unreasonable usage has occurred on the account at any time.

  • User Pin #

    • We will send you a user pin # for your account once you have completed the registration process. It is your responsibility to maintain the confidentiality of your user pin #. You should notify us if you become aware of any unauthorized use of your user pin #, account use or any other breach of security.

  • Your Registration Responsibility

    • It is most important that PhoneTag be able to rely on the information that you provide us about you, and therefore you must confirm that you have provided and will provide accurate, current, and complete information about yourself to us and agree to inform us if that information changes. Should we suspect that you have not done this, we may have to suspend or terminate your account. We will guard your information very carefully and will only use your information in accordance with our Privacy Policy, which can be found by clicking here.

  • Confidentiality

    • We will not disclose outwardly any of the information that has been designated to be confidential or that is obviously confidential in nature. By "Outwardly" we mean persons other than employees, representatives, or any third parties who need to receive the information to provide the service.

  • Personal Information

    • We guarantee that we will follow all relevant data protection laws and regulations. In particular, we will never make available any personal data without consent unless necessary in providing the service.

  • Protection

    • You will indemnify and hold us and our employees, officers, agents, and subsidiaries harmless from any expenses, damages, or losses, including any legal fees or consequential losses due to your use of the service. You may not reproduce, duplicate, copy, sell, resell, or exploit for any commercial purposes, any portion of the PhoneTag service.

  • Services Modifications

    • We reserve the right to modify or discontinue, temporarily or permanently, the service, with or without notice and liability to anyone. We reserve the right to terminate your User Pin #, password, or use of the service, and remove and discard any content within the service.

  • User Conduct

    • We at PhoneTag cannot be held responsible for any of the text, sound, or content of any of your messages. We do not believe in screening content. We do not allow our service to be used to send marketing material. Should you send any message deemed to be marketing material or spam through the PhoneTag service, you will be charged $100 for each and every person or number that receives this unauthorized message.

  • PhoneTag's Rights

    • The service and the software required to provide the service are the intellectual property of PhoneTag and is protected by law. In joining our service, you agree that content contained in information presented to you through the PhoneTag service is protected by copyright, trade mark, patents and other proprietary rights and laws. You are prohibited from accessing the service through any other means than through the interface provided to you by PhoneTag.

  • Notices

    • Notices of any changes to the PhoneTag service will be sent by email, SMS, or through our website. Feel free to contact us for any reason through any of the numbers provided in our contact information made available on our website.

  • PhoneTag Error Tracking

    • PhoneTag reserves the right to automatically send logs from the mobile application for error tracking purposes.

  • Service Disclaimer

    • Some messages cannot be transcribed due to poor dictation, noisy environment, poor phone connection or drop-outs, or language. In this event, you will be notified by SMS so that you can be alerted of the new voicemail and listen to it on your voicemail box.

  • Limitation of Liability

    • We do not control the content and are therefore not responsible for any errors or omissions in any of the content we provide even if it is a result of negligence. We are not liable for any indirect loss or for loss of profits, goodwill, time use, data or other intangible losses.

  • Permitted Usage of Unlimited Plan

    • The Unlimited Plan is intended for usage by a sole individual (hereinafter "Account Holder"). Account Holders are not permitted to use their Unlimited Plan such that the voicemail box covered by the Unlimited Plan a) is a general voicemail box for a multi-employee business or one assigned to a multi-employee department in a business, rather than one assigned specifically to the Account Holder; b) is used to receive calls to persons other than the Account Holder; or c) is otherwise used by the Account Holder in a manner deemed by PhoneTag in its reasonable discretion to be abnormal or unreasonable. PhoneTag reserves the right to terminate any Unlimited Plan that is used in a manner that is not Permitted Usage.

  • Refer a Friend Program

    • Offer only valid if your friend signs up using the internet link provided pursuant to the email sent to you. Offer not valid for purchase of PhoneTag at any store or other Internet link. Offer may not be combined with any other offer or promotion. Use of PhoneTag by your friend will at all times be subject to the terms of the service contract between PhoneTag and your friend, including but not limited to the Terms and Conditions and Privacy Statement stated above and elsewhere in this website, as those terms exist at the time your friend signs up for service. This promotional program may be terminated at any time by PhoneTag. You will not be eligible for any credits under this promotion if your friend fails to sign up within five business days of the termination of this promotion. Void where prohibited by law.
